Waiver of Liability, Refund & Cancellation Policy, Behavior Policy

In consideration for myself and/or my minor children being permitted by the Carnegie Arts Center Foundation (CACF) to participate in activities described in the class schedule, I hereby waive, release and discharge any and all claims and damages for personal injury, death, or property damage which I or my minor children may sustain or which may occur as a result of my or my minor children’s participation in these activities. I understand and agree that:

This release is intended to discharge in advance the CACF, its officers, employees & agents, and the City of Turlock, its officers, employees & agents, from and against any and all liability except for their sole negligence or intentional acts, connected in any way with the participation of myself or my minor children in activities;
The described activity may be of a hazardous, strenuous, and /or physical nature and participation may occasionally result in injury, death or property damage;
Knowing the risk involved, nevertheless I voluntarily request permission for myself or my minor child to participate in the described activity;
I hereby assume any and all risks of injury, death or property damage, and to release and hold harmless the CACF, its officers, employees & agents, and the City of Turlock, its officers, employees & agents, except for their sole negligence or intentional acts;
I will indemnify and hold the CACF and the City of Turlock harmless from any loss, liability, damage, cost or expense, including litigation, which they may incur as a result of any injury and/or property damage which myself or my minor children may sustain while participating in said activities;
I will make good any loss or damage or cost the CACF or the City of Turlock may have to pay if any litigation arises on account of any claim related to the described activity;
In the event that said minor requires medical treatment or surgical treatment while under the supervision of CACF personnel in connection with the described activity, such supervisor may authorize treatment;
I will pay all medical, hospital, or other expenses which I or my minor children may incur as a result of such treatment
Activities are not child care as defined by the State of California;
CACF staff may photograph or videotape me and/or my minor children and CACF may use such photographs or videotape to promote CACF programs and classes. I expressly allow, and hereby waive any objection to, the CACF’s photographing and/or videotaping of me and/or my minor children when I or my minor children are participating in a CACF activity or program. I understand all photos and videotapes remain the property of the CACF;
The CACF is not responsible for children following the dismissal of a program.

I certify that I and/or my minor children are physically able to participate in the described activities. I have carefully read this Waiver of Liability and fully understand its content. I am aware that this is a release of liability and by enrolling myself or my children in a CACF activity I agree to the terms of this waiver. I also understand the Refund Policy and the Behavior Policy and the potential consequences set forth by the CACF and agree to abide by them.

Refund & Cancellation Policy

All refund or cancellation requests must be made via email to megan@carnegieartsturlock.org or in person at our offices, 250 N. Broadway.

95% refunds will be given if requested 14 or more business days before the first class date.
75% refunds will be given if requested 7-13 business days before the first class date.
50% refunds will be given if requested 2-6 business days before the first class date. If class begins on Wednesday, refund request must be received by Monday.
No refunds will be given if requested one day or less before the start of class.

Behavior Policy

It is our goal to provide safe, positive and fun experiences for all participants in our programs. In order to achieve this goal, participants are expected to:

Be respectful of the feelings and properties of others.
Not interfere with the learning of other participants.
Follow instructions and rules as stated by the instructor or leader.
Not verbally or physically harm another person or property.
Use appropriate language.

Consequences for misbehavior will reflect the severity of incident. We will use a progression of discipline:

Warning
Time Out
Phone call to the parent/guardian
Removal of the child for the day or temporary suspension from program
Dismissal from program

No refund will be given if a participant is suspended or dismissed from a program because of behavior.
