CORE VALUES AND CODE OF CONDUCT

I, the Parent / Guardian / Adult Participant (hereafter known as the payor) understand the responsibility that my family is undertaking by becoming a member of Cheer Sport Sharks Newfoundland (CSSNL). I agree to

fully support CSSNL and all of its members.
to abide by CSSNL’s Core Values - HERE
represent CSSNL with class and respect.

I understand that any participant/ward/child (hereafter known as the athlete) or payor that does not abide by the rules, regulations, policies and Core Values of CSSNL, or acts in a manner that jeopardizes the name and reputation of CSSNL, will be subject to removal with no refund.

RELEASES, WARRANTS, AND ACKNOWLEDGEMENTS

LIABILITY RELEASE: I, the payor, certify that I have authority with respect to custody and care of the athlete and understands that CSSNL is relying on this certification.I give permission for the athlete to participate in any of the following CSSNL activities: competitive team training sessions, competitions, competitive team travel, exhibitions, community events, recreational classes, martial arts classes, tumbling classes drop-in programs/clinics, camps and/or camp activities, rentals and birthday parties. I release CSSNL, including directors, employees, volunteers, subcontractors, vendors, from any and all liability from any claim, demand, action or cause of action of any kind arising from any illness, injury or death of the participant as a result directly or indirectly participating in an activity listed above with CSSNL. This indemnity extends to and includes all costs, legal or otherwise, incurred in defending such claims, demand, action or cause of action.
MEDICAL RELEASE: I, the payor, hereby certify that the athlete does not suffer from any physical, mental, or medical condition that would pose a risk to the athlete while attending or participating in any CSSNL activities including competitive team training sessions, competitions, competitive team travel, exhibitions, community events, recreational classes, martial arts classes, tumbling classes drop-in programs/clinics, camps and/or camp activities, rentals and birthday parties. By agreeing to the terms of this form, I acknowledge that participation in activities with CSSNL. involves certain inherent risks and regardless of the precautions taken, the athlete may sustain injuries (minor, serious, catastrophic or fatal). I on my own behalf and on behalf of the athlete, hereby assume all responsibility for any such risk and releases CSSNL. from any claims, demand, action or cause of action of any kind with respect to such injury. I authorize CSSNL. to provide first aid treatment in event of an injury to the athlete. If no medical treatment is provided, or if the provided treatment is ineffective, CSSNL. will not be liable in any way. I shall be responsible for all costs of any such treatment and indemnifies and holds harmless, CSSNL. or representatives in this regard.
SAFETY STATEMENT: I, THE PAYOR, OR THE ATHLETE WILL IMMEDIATELY STOP THE ATHLETE'S PARTICIPATION and INFORM THE NEAREST OFFICIAL If, during the course of my participation:
- I or the athlete learn or become aware of a change in my health, physical, emotional or mental condition, or
- I or the athlete feel unsafe or threatened for any reason, or
- I or the athlete notice anything unsafe about the program,
GYM RULES AND POLICIES: I, the payor understand, and will instruct my athlete, that all gym rules for participation must be followed and that at all times. These rules can be posted in the gym or shared by staff.
USE OF IMAGE: I, the payor, acknowledges that CSSNL. and affiliates from time to time produce video, website content, social media posting, photographs, printed material, and voice recordings for promotional or commercial use. I, and on the behalf of the participant, acknowledge that the Participant may be included in such recordings as an athlete or spectator with CSSNL. and consents to the same.I hereby transfer and assigns to CSSNL., the exclusive right to make such recordings and utilize the Participant's image and/or voice for current or future promotional or commercial use.

CANCELLATION, REFUND, WITHDRAWAL AND ALTERNATIVE PAYMENT POLICIES

PAYMENTS: I, the payor, agree that I am fully responsible for all payments under this agreement, , without limitation. By agreeing to these terms the I give CSSNL authorization to charge my account for any fees that are more than 15 days past due.
FORM OF PAYMENT: I, the payor, agree that for monthly payments CSSNL accepts Credit Cards, Pre-Authorized Payments (P.A.P) direct from a bank account. If paying in full CSSNL will also accept debit card payments and cash.
IMPORTANT PAYMENT DATES: I, the payor, understand the important payment dates used at CSSNL to be:
- 25th of the month - Normal payment date for the next month of service
- 1st of the month - last day to make a payment to avoid a processing fee
- 2nd of the month - Processing fee applied to account
- 5th of the month - Athletes with overdue accounts sit out of practice
CURRENCY I, the payor, understands that all charges noted on the ledger are indicated in Canadian Dollars (CDN$). All payments processed will be done in Canadian Dollars (CDN$)
GYM-WIDE CLOSURE / CANCELLATIONS DUE SPECIFICALLY TO COVID-19 **In place for ALL programming. Any gym wide cancellations due to any COVID-19 related situations (mandated government closure, gym exposure) will be dealt with in the following steps:
- Missed time due to a closure will be made up through additional scheduled time when reopened and/or virtual training opportunities to keep athletes engaged during the closure.
- Prorated credits will be given, when possible, if the situation outlined above is not possible.
- If a REFUND is available, families will be made aware and a google form will be sent via email and posted on location facebook pages. The form should be filled out to confirm your request for the refund. The form must be filled out within the timelines provided to be eligible.
ALL TEAMS (NOVICE, ALL-STAR, WORLDS, NON-TUMBLE, ETC):
- WITHDRAWAL
  1. 10 Days after first payment - 100% Refund
  2. 11-90 days after first payment (3 months) - 75% of fees not already allocated by the gym on the athlete’s behalf will be refunded
  3. 91-180 days after first payment (6 months) - 65% of fees not already allocated by the gym on the athlete’s behalf will be refunded
  4. 181+ days after first payment (after 6 months) - No Refunds will be issued.
  5. Withdrawal requests must be sent at least 10 days' prior to any scheduled payments to allow for adjustments. All withdrawal requests must be made via email to program managers and/or newfoundland@cheersportsharks.com
- REMOVAL
  1. Any athletes / families that are asked to leave the program for any reason (including but not limited to: not following policies outlined by CSS Newfoundland and any associated organizations, non-payment, inappropriate behavior, negativity etc) will forfeit any monies that have been paid. There will be no option for refund of any team fees.
LATE FEES: On the 10th of the month, any overdue fees will incur a $25 + HST late penalty. By the 15th of the month, an athlete with an outstanding balance (for any programming, apparel, fees, etc) may not be able to participate and could be asked to sit out of practice, until an arrangement is put in place. This may impact their participation in upcoming competitions.
ALTERNATIVE PAYMENT OPTIONS: Alternative payment arrangements for any program at CSSNL can be requested via appropriate staff members listed below. Some examples of payment arrangements may be:
- A different day of the month you would like the payment to come out on. We charge our team instalments on the 25st of the month prior, but if a different day suits you we are happy to accommodate.
- Split monthly payments : Do you want to pay for your monthly fees with two separate bank accounts or two different family members?
- Extended monthly payments: Do you need a month or two extra to pay for your fees?
DROP IN CLASSES: Refund requests can be made up to 14 days prior to class date. Rescheduling or request for a credit can be made up to 7 days prior to class date. Written notice is required in order to complete any requests. Any late arrival will shorten the class time and will not be made up by running into the coaches next scheduled class. Emergency absences will be considered on an individual case by case basis by CSSNL
- Drop in classes booked with a multipass will be subject to the Multipass policy.
- Swap and Sell : We recommend and encourage you to try and sell your class to another athlete if you are able to do so. Any and all interactions to do with selling and/or times of classes will be the responsibility of the seller to communicate to the purchaser. CSSNL is not responsible for any miscommunications of class times or exchanging of funds.
GUEST INSTRUCTOR CLASSES: No refund or credits are available for any activity booked with a guest instructor.
SESSION BASED ACTIVITIES:
- 14 Days prior to start date - 100% Refund or Credit
- After 50% completion of session - No refunds will be issued.
- (Ex. 12 week recreational class - after week 6 is complete, there will be no option for credit or refund)
- Session based activities are specifically restricted to the athlete that was enrolled in the session. This means the spot may not be sold to another athlete. Refunds or credits will not be given for any class(es) the athlete is unable to attend. If you need to withdraw from the session, you must reach out to the appropriate staff member listed at the end of this document.
MULTIPASSES (TUMBLING OR SKILLS):
- 7+ days email notice is required for any cancellation or rescheduling changes to class(es) booked with your multi pass. You may unregister from any activity booked with a multi pass on your own through your Amilia account up to 7 days prior to the class date.
- Requests to process a cancellation of a multipass must be submitted via email to the appropriate staff listed at the end of the document. The cancellation will be based on the number of classes you have used vs the amount you have paid for the multipass. The number of classes you have used will be charged at the full rate for that specific class type. This will then be netted against the amount you have already paid for the multipass. Any of the money that remains will be eligible for refund minus a $50 administrative fee.
- Athletes that quit or are removed from the competitive program will result in cancellation of any multi passes remaining on the account and will follow the above policy. Tumbling Multipasses are for Shark Athletes only*
CAMPS: Requests to process a withdrawal from a camp must be submitted via email to the appropriate staff listed at the end of the document.
- Full Week Camp
  1. 14 days prior to start date or camp - 100% refund is available
  2. Less than 14 days prior to start date or camp - 100% credit with a $25 administrative fee is available OR 100% refund with a $50 administration fee is available.
  3. No refunds or credits will be given past the start date of camp.
- Single Day / Drop In Camp
  1. 7+ days prior to your single day or drop in date - 100% full refund or credit is available
  2. Less than 7 days prior to your single day or drop in date - No refunds or credit is available
RENTALS: Any rental cancellation or refund requests need to be submitted via email to the Rental coordinator. These requests will be assessed on a case by case basis. Any cancellation/refund request within 2 weeks of a rental date may not be accomodated.
BIRTHDAY DAY PARTIES: Any Birthday Party cancellation or refund requests need to be submitted via email to the Birthday Party Coordinator. These requests will be assessed on a case by case basis. Any cancellation request within 2 weeks of a party date may not be accomodated.
GYM CLOSURES/CANCELLATIONS (INCLUDING SNOW DAYS): In the event of a gym closure due to weather or other extenuating circumstances (other than COVID-19 related instances, for which you will refer to the above policy), all team practices and session based programs will not be refunded or credited. The missed practice(s) may be rescheduled at the gym/coach’s discretion. ALL tumbling semi private/private classes, clinics and any additional drop in skills classes will be credited to the account or if a multi pass was used for initial booking, the pass will be added back for future use. This refunded pass must be used during the current season and will not carry through to future seasons.
GYM INJURY POLICY: If an injury occurs within the gym and an athlete has a drop in class (any tumbling or skills classes) within 7 days, as long as written notice is sent via email within 24 hours of the injury, we will credit the account for that ONE class. However, if the injury exceeds the 7 day window it is the family’s responsibility to log into Amilia and adjust their schedules as needed. This is strictly for injuries that happen within the gym. If an athlete is injured outside of the gym it is up to the family to sell any class that falls within the 7 day policy.
Apparel
- Fins Pro Shop:
  1. Any FINS Pro Shop purchase of an in stock item is eligible for a full refund within 7 days of the order being picked up/shipped. In stock items can also be exchanged or credited up to 30 days after the order has been picked up/shipped.
  2. Any pre-order FINS Pro Shop items can be returned for exchange or credit only, based on the availability of the items. This must be done within 30 days of the order being picked up/shipped. You will find if an item is “Pre-order” in the item descriptions in the Amilia store.
  3. All returns or exchanges are based on availability of sizes and a staff member ensuring the returned item is in new condition and has not been worn.
- Fin Frenzy Subscription Box
  1. All items in the Fin Frenzy Subscription box can be exchanged if there are any sizing issues based on item availability. This can be done up to 10 days after the order has been picked up/shipped. All requests will be handled on an individual basis. Please email to inquire about any changes or exchanges.
  2. You may cancel your subscription box by email with 30 days notices prior to the seasonal charge dates. All requests submitted after the 30 days will be processed on next subscription. It will not reflect the immediate upcoming box. Refunds will not be available once charges have been processed.
- Mandatory Team Items
  1. Any orders for uniforms, scrunchies or warm-up suits cannot be refunded or credited after the order is submitted with the supplier. Once the item is picked up by the purchaser, any size exchanges will be determined on an individual case by case basis. All returns or exchanges will depend on availability of sizes and a staff member ensuring the returned item is in new condition and has not been worn.
  2. Scrunchies are personal items and therefore final sale, once picked up by the athlete/family.
- Swap and Sell:
  1. We like to suggest you use your location specific “Swap and Sell” facebook page to sell any team items that are no longer needed. All interactions to do with selling of items will be the responsibility of the seller/purchaser. CSST is not responsible for quality of items or exchanging of funds when using this page.
- Custom Orders
  1. Custom team item orders (individual team items or program-wide custom team items) cannot be cancelled for a refund or credit once the order is placed with the supplier. There are no size exchanges available for these items.

GENERAL POLICIES:

COMMUNICATION: It is the parent’s responsibility to stay informed. Check your email and TeamApp regularly, if you are not receiving emails contact the front desk immediately so we can check your account. Each week you should receive a weekly email with updates and announcements. If you are receiving statements, then your weekly email is being sent to spam by filters.
WHAT TO WEAR: I, the payor, understands that athletes may wear a T-Shirts/Tank Top/Sport Top and shorts. I understand that
- there should be NO chewing gum
- No dangling jewelry.
- Hair should be pulled neatly and securely away from the face so that is stays up for the entire class/practice.
- All students should have activity-appropriate footwear during class.
- In the event that an athletes footwear is not appropriate, a conversation with a parent or guardian may take place.
- Athletes that forget their shoes will be required to practice in their socks.
- Any additional risk posed by this will be assumed by the athlete and parent.
- Personal items should be left in cubby holes. Jewelry should not be worn during classes. PLEASE LEAVE ALL VALUABLES AT HOME. The CSSNL staff will not be responsible for ANY items that may be lost or stolen. Be sure your student’s personal items are marked with their name.
PICKUP: I, the payor understand that all athletes should be picked up on time. Our staff does their very best to end classes at the published time. Please inform us if you know you will be late picking up your athlete. For all Junior aged athletes and younger, we ask that I instruct my athlete to wait inside the building and that I should escort them from the building to your car. I understand that during peak times the parking lot is very busy. I WILL take into consideration that our athletes may include young children and I WILL drive slowly and carefully. I will not take a chance on your student running to and from your car.
COMPETITIVE PROGRAM MANDATORY ATTENDANCE: I, the payor, understand that All athletes are to attend their teams regularly scheduled practices. If an athlete is not feeling well, or injured, they are still expected to be at practice. If your child has a fever or is vomiting they should not attend. A parent must call the office or team coach PRIOR to practice for this to be excused. All school activities and pre-planned vacations should be submitted 14 days in advance online as explained in the packet. If your athlete reaches 10 missed practices, unexcused or excused, a meeting with the All-Star director will take place. At this time your child may be removed from the team at the discretion of the All-Star Director. Attendance is required for success.
INJURY OR ILLNESS: I, the payor understands that should my athlete miss practice due to illness or injury that a medical form stating they are cleared to return to full team duties must be signed by a licensed practitioner and presented to CSSNLs before my athlete is allowed to participate in practice and/or competitions. I understand that missing practice due to illness or injury may result in my athlete’s role in the routine being affected.
ATHLETE SAFETY: I, the payor understand that cheerleading is a dangerous sport, regardless of age, and I will keep the athletes’ safety as my top priority when allowed in the waiting area. I understand that calling out to athletes or distracting them in any way is not safe and I understand that should I, or any other person with me, be distracting and jeopardize the safety of the athletes on the floor, we will be asked to leave the gym during practice.
SKILLS RETENTION: I, the payor understand that competitive team athletes are expected to maintain, at the minimum, the skills they have demonstrated prior to the beginning of the season. I understand that should my athlete fail to maintain the skills they have previously shown, CSSNL reserves the right to alter their role on the team, including, but not limited to, placing them on a different team. I further understand that although CSSNL does its best to place athletes where staff believe is best suited for athlete potential, CSSNL reserves the right to place my athlete on a different team should staff determine that my athlete’s demonstrated skills are not in the best interest of the team or the athlete.
UNSPORTSMANLIKE BEHAVIOUR: I, the payor understand that unsportsmanlike behaviour is detrimental to the success of CSSNL and its athletes, and can affect the gym’s ability to attend competitions now and in the future. I understand that treating any staff member or athlete, whether associated with CSSNL or any other gym or business, with disrespect (including, but not limited to, yelling, swearing, calling names, complaining to other parents or athletes) may result in dismissal from the gym with no refund. I also understand that unsportsmanlike behaviour relayed over social media in any form may also result in dismissal from the gym.
SOLICITATION: I, the payor understand that should I, or any person in relation to me or my athlete, be heard to entice or force other athletes into leaving CSSNL, we will be asked to leave the gym, effectively and immediately terminating our membership with no refund.
ALTERING CSSNL GEAR: I, the payor understand no item provided to the athlete by CSSNL may be altered in any way, including the addition of names, decoration, or logo, without the express permission of CSSNL. I understand that should I choose to alter CSSNL gear in any way without permission, I will be subject to replacing said gear at my own expense. Furthermore, I understand that the use of CSSNL’s name, logo, or team names is prohibited without the express permission of CSSNL.
TRADEMARK AND LOGO: I, the payor, understand that as a CSSNL member I am NOT allowed to use ANY CSSNL Logo, Branding or any CSSNL imagery to make merchandise, social media accounts, or any other product. I cannot sell or create my own CSSNL Clothing or merchandise. I also understand I am not allowed to contact any vendors on behalf of CSSNL, doing so is grounds for dismissal from the program.

Covid Additional - Assumption of risk

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is contagious and is believed to spread mainly from person-to-person contact. As a result, federal, provincial, and local governments and federal and provincial health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Cheer Sport Sharks (“the Club”) has put in place preventative measures to reduce the spread of COVID-19; however, the Club cannot guarantee that you or your child(ren) will not become infected with COVID-19.
Further, attending the Club could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Club and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with mychild(ren)’s attendance at the Club or participation in Club programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Club program.

I THE PARENT / GUARDIAN / ADULT PARTICIPANT (THE PAYOR) UNDERSTAND AND AGREE, ON BEHALF OF THE CHILD / WARD / ADULT PARTICIPANT (THE ATHLETE), MYSELF, MY HEIRS, ASSIGNEES, PERSONAL REPRESENTATIVES AND NEXT OF KIN, THAT

I acknowledge and understand that I have had the opportunity to seek independent legal advice in relation to this agreement.
I acknowledge and agree that I have read and fully understand these terms. I confirm that I am executing this agreement voluntarily and willingly.
I acknowledge and understand that this membership is not based on usage and that I am bound to the terms, fees regardless of how often the participant(s) use the facilities.
I have read and understand the policies, written as well as the financial, time and travel commitment associated with my registration and acknowledge that the policy and procedures may be subject to change at any time.
I understand that I can request an electronic copy of these terms, in person or through email at (newfoundland@cheersportsharks.com) be shared with me at the time that I agree to them.
I understand that any athlete or payor that does not abide by the rules, regulations, policies, and Core Values (HERE) of CSSNL, or acts in a manner that jeopardizes the name and reputation of CSSNL, will be subject to removal with no refund.
