Terms & Conditions and Participant Agreement

By registering online, I acknowledge that I have read, understood, and agreed to all the terms and conditions outlined below.

1. Core Values & Code of Conduct

Summary: All members of Cheer Sport Sharks Toronto are expected to uphold our values, respect others, and represent the program with integrity.

As a Parent, Guardian, or Adult Participant (hereafter “the Payor”), I understand the commitment my family is undertaking by becoming a member of Cheer Sport Sharks Toronto (CSST). I agree to:

Fully support CSST, its staff, athletes, and families.
Uphold CSST’s Core Values of “We Before Me”, putting the needs of the team and program above personal interests.
Represent CSST with class, integrity, and respect at all times, inside and outside the gym.

I understand that any athlete or payor who does not follow CSST’s rules, regulations, policies, or Core Values, or whose actions negatively impact the reputation of CSST, may be removed from the program without refund.

2. Liability & Medical Releases

Summary: You acknowledge the inherent risks of cheerleading and release CSST from liability for injury, illness, or other incidents that may occur during participation.

2.1 Liability Release

I certify that I have authority regarding the custody and care of the athlete and give permission for them to participate in all CSST activities, including but not limited to: team practices, competitions, travel, events, classes, camps, clinics, rentals, and birthday parties.

I release CSST, its directors, employees, volunteers, subcontractors, and vendors from any and all liability, claims, or actions resulting from illness, injury, or death arising directly or indirectly from participation in any CSST activity.

2.2 Medical Release

I certify that the athlete does not suffer from any physical, mental, or medical condition that would pose a risk during participation in CSST activities.
I acknowledge that cheerleading involves inherent risks, including minor, serious, or fatal injuries, and assume full responsibility for such risks. I authorize CSST to provide first aid treatment in the event of injury and understand that if treatment is ineffective or unavailable, CSST is not liable. All related medical costs remain my responsibility.

2.3 Safety Statement

If at any time the athlete:

Experiences a change in health or feels unsafe, or
Notices any unsafe condition,

the athlete or I will immediately stop participation and inform a CSST staff member.

2.4 Gym Rules

All athletes must follow posted or communicated gym rules and policies at all times. Failure to do so may result in removal from class or program participation.

2.5 Use of Image

I acknowledge that CSST and its affiliates may capture video, photographs, or audio recordings during activities for promotional or educational use.
I grant CSST full rights to use such media, including the athlete’s image or voice, in promotional materials, advertising, and online content without compensation.

3. Payment & Refund Policies

Summary: Payments are due monthly and are binding. Late fees, refund schedules, and withdrawal policies are clearly outlined below.

3.1 Payments

I am fully responsible for all payments under this agreement. By agreeing to these terms, I authorize CSST to charge my account for any fees more than 15 days past due.

Accepted payment methods:

Monthly fees: Credit Card or Pre-Authorized Payment (P.A.P.)
Full payments: Credit Card, Debit, or Cash

Important payment dates:

25th of each month: Regular payment date for next month’s tuition
10th of each month: Late fee applied ($25 + HST)
15th of each month: Athletes with overdue accounts may be required to sit out of practice

Note: Participation, usage, or attendance has no impact on fees paid.
Refunds or credits will not be provided due to missed classes, practices, or absences for any reason.

3.2 Refunds, Withdrawals & Apparel Policies

Refunds follow the timeline below (applies to all competitive teams):

Withdrawal requests must be submitted by email to toronto@cheersportsharks.com at least 10 days before the next scheduled payment.

Apparel & Pro Shop

In-stock items: Refund within 7 days; exchange or credit within 30 days of pickup or shipment.
Pre-orders: Exchange or credit only within 30 days (based on availability).
Custom orders and uniforms: Final sale once the order is submitted to the supplier.
Swap & Sell: Families may use the location-specific “Swap & Sell” Facebook page to resell used items. CSST is not responsible for private transactions or item condition.

3.3 Late Fees

Overdue accounts will incur a $25 + HST late fee after the 10th of the month. Athletes with unpaid balances after the 15th may be held out of practices and/or events until payment is resolved.

3.4 Refund Policies by Program Type

Drop-In Classes:
- Refunds up to 14 days prior to class.
- Credit or reschedule up to 7 days prior.
Guest Instructor Classes: No refunds or credits.
Session-Based Programs:
- 100% refund or credit up to 14 days before session start.
- No refunds after 50% of session completed.
Multipasses:
- Minimum 7 days’ email notice required for cancellations.
- Refunds are prorated based on usage, less a $50 admin fee.
Camps:
- 14+ days before camp: 100% refund.
- Less than 14 days: Credit (minus $25 fee) or refund (minus $50 fee).
- No refunds after camp start.
Rentals/Birthday Parties:
- Must be requested via email; decisions made case-by-case.

3.5 Alternative Payment Options

Payment adjustments (split payments, alternative dates, or short-term extensions) may be arranged through CSST staff upon request.

3.6 COVID-19 Related Cancellations

If gym-wide closures occur due to government mandates or exposure:

Missed time will be made up through extra sessions or virtual classes.
Credits may be issued if makeup sessions are not possible.
Refunds, if applicable, will be processed through an online form shared by email.

3.7 Participation, Financial, Time & Travel Commitments for All-Star Teams

Summary: All-Star Cheerleading Team participation includes specific financial, time, and travel expectations that support the team’s success and ensure full transparency for families.

By registering with Cheer Sport Sharks Toronto (CSST), I understand and agree that:

Participation in All-Star Cheerleding Team programs involves a financial commitments related to training, apparel, travel, and competition expenses.
Attendance and engagement at all scheduled practices, performances, and competitions are mandatory to support team development and success.
Local (in-province) events and associated coaching costs are generally included in the All-Inclusive Program Fees.
- If this changes due to circumstances beyond CSST’s control (e.g., event schedule or policy changes), families will be notified as soon as possible.
Out-of-province / International events and their entry fees and coaching travel costs are not included in the All-Inclusive Program Fees.
- CSST will announce and publish an estimated cost and then communicate the final confirmed amount as soon as this information becomes available.
- While CSST will make every effort to keep payors informed of out-of-province costs, it remains the payor’s responsibility to stay up to date on all related fees and announcements.
Travel, accommodation, and spectator entry fees are never included in the All-Inclusive Program Fee unless explicitly stated otherwise in advance.
Refunds will not be provided for missed practices, travel conflicts, or voluntary withdrawal after refund deadlines.
These commitments are necessary to maintain fairness and uphold the standards of the CSST All-Star program.
Routine Adjustments, CSST coaches have the discretion to make changes to any team’s routine at any time, including adjustments to athlete roles, floor placement, or, if deemed necessary for the team’s success, temporary or permanent removal from the routine. These decisions are made solely in the best interest of the team and the program’s competitive goals.

4. General Program Policies

Summary: Clear expectations ensure safety, professionalism, and positive experiences for all CSST members.

4.1 Communication

Parents must stay informed through official CSST emails and band updates. Contact toronto@cheersportsharks.com if not receiving notices.

4.2 Dress Code

Athletes must wear athletic tops and shorts, proper shoes, and have hair tied back. No gum, jewelry, or valuables. CSST is not responsible for lost or stolen items.

4.3 Pickup & Safety

Parents must pick up athletes on time. Athletes under 12 age must wait indoors for pickup. Drive carefully in the parking lot and be mindful of children.

4.4 Attendance (Competitive Programs)

Attendance is mandatory for all scheduled practices and events. Absences due to illness or injury must be communicated in advance. After 10 absences, a meeting with the All-Star Director will occur and team placement may be reviewed.

4.5 Injury & Return Policy

If an athlete is injured, a doctor’s note confirming clearance is may be required before returning. Missed practices may affect routine placement.

4.6 Athlete & Parent Behavior

Unsportsmanlike behavior, including but not limited to disrespect, negativity, gossip, or inappropriate social media posts, may result in immediate dismissal without refund.

4.7 Solicitation & Representation

Parents or athletes may not solicit others to leave CSST, alter CSST gear, or use the CSST logo/name for personal merchandise or social media without written approval.

5. COVID-19 Assumption of Risk

Summary: By attending CSST, you acknowledge and accept the risks associated with COVID-19.

I acknowledge that COVID-19 is contagious and that participation at CSST could expose myself or my child to infection despite preventive measures.
I voluntarily assume all risks related to COVID-19 exposure and release CSST, its employees, and representatives from all claims related to illness or injury resulting from such exposure.

6. Final Acknowledgement & Agreement

Summary: This section confirms your understanding and consent to all policies and conditions.

By registering with Cheer Sport Sharks Toronto (CSST), I confirm that:

I have read and fully understand all policies, terms, and conditions.
I accept all risks associated with participation in CSST programs.
I understand this membership is binding regardless of usage or attendance.
I acknowledge that these terms may be updated as needed and agree to comply with current policies.
I understand I may request an electronic copy of this agreement by contacting toronto@cheersportsharks.com.
I agree that violation of CSST’s Core Values of “We Before Me” or conduct harmful to the program may result in removal without refund.

By completing online registration, I confirm that I have read, understood, and agreed to all terms outlined above.
