By enrolling your child with Eunoia Forest School Inc. (Herein collectively referred to as "Eunoia Forest School" you hereby agree to the Terms and Conditions outlined in this enrollment package and Eunoia Forest School's Policy and Procedures.

A. CONSENT TO TREATMENT

A1. All children registered with Eunoia Forest School must have adequate health insurance in Ontario under the Ontario Health Insurance Plan.

A2. In the event of a medical emergency, accident, or illness involving your child, you hereby authorise Eunoia Forest School, it’s owner, directors, employees, servants, staff, volunteers, placement students, and agents to act on our behalf to administer first aid, call for an ambulance and/or transport your child to a nearby emergency or medical facility, if necessary, and/or authorise medical treatments to be given to our child. The emergency or medical facility and its staff have my permission to provide any treatment the qualified health professionals deem necessary for the health of my child at the cost of the parent.

A3. I hereby release Eunoia Forest School, it’s owner, directors, employees, servants, staff, volunteers, placement students, and agents from any and all claims arising from their exercise of authority granted herein. I/we further release Eunoia Forest School, its owner, directors, employees, servants, staff, students, placement students, and agents from any and all claims for injuries or other damages, however caused, arising from our child’s attendance at Eunoia’s program and participation in Eunoia Forest School’s activities.

B. WAIVER AND RELEASE - INFORMED CONSENT

B1. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS - Informed Consent of Activities. The Parent/Guardian acknowledges that their child will have the opportunity to engage in activities such as, hiking on uneven and sometimes slippery or rocky grounds, tool use (using a manual hand drill, knives, hammers etc. under supervision), stick play, and many more activities in all weather conditions that have known and unknown dangers and risks associated with participation, including but not limited to, the risk of minor injuries such as cuts, bruises, and scrapes, insect bites, insect stings, other injury and/or illness from wild animals and plants, weather-associated injuries or illness, and more. As well as the risk of serious illness/injury resulting from the actions of other children or negligence on the part of other participants, including but not limited to other serious illness/injury and death. The Parent/Guardian acknowledges and agrees that he or she understands the aforesaid dangers and risks associated with the outdoor activity program and notwithstanding such dangers and risks agrees to provide his or her permission for their child to participate in Eunoia Forest School Inc. outdoor activity program.

B2. RELEASE AND WAIVER OF CLAIMS - The Parent/Guardian releases, waives, and fully discharges Eunoia Forest School Inc. and The Corporation of the Town of Whitby and The Central Lake Ontario Conservation Authority from any and all claims, demands, obligations and liabilities of any kind or nature whatsoever arising from or connected, directly or indirectly, with the Child’s participation in the outdoor activity program due to any cause whatsoever, and the Parent/Guardian accepts that this release covers and includes, but is not limited to, all unknown and unforeseen claims, injuries, damages and losses, and any consequences thereof.

B3. INDEMNITY - The Parent/Guardian will indemnify and hold harmless Eunoia Forest School and the Corporation of the Town of Whitby and The Central Lake Ontario Conservation Authority from any damage, loss, liability, legal costs and other expenses that Eunoia Forest School Inc. may suffer or incur by reason of any claims against Eunoia Forest School Inc. arising from or connected, directly or indirectly, with the Child’s participation in the outdoor activity program, including any claim based on negligence, breach of contract, and breach of statutory duty or other duty.

BY SIGNING BELOW, I HAVE READ THIS RELEASE AGREEMENT THOROUGHLY AND UNDERSTAND THE TERMS OF THIS RELEASE AGREEMENT.

I UNDERSTAND THAT, BY SIGNING THIS RELEASE AGREEMENT, I GIVE UP IMPORTANT LEGAL RIGHTS, INCLUDING, BUT NOT LIMITED TO, THE RIGHT TO SUE.

I UNDERSTAND THAT EUNOIA FOREST SCHOOL INC. IS RELYING UPON MY FULL RELEASE AND WAIVER OF ALL CLAIMS WHEN ALLOWING MY CHILD TO PARTICIPATE IN THE OUTDOOR ACTIVITY PROGRAM.

C. POLICY AND PROCEDURES

C1. All children enrolled with Eunoia must have a Parent/Guardian sign the "Assumption of Risks Waiver and Release of Claims Indemnity Agreement" prior to their start date. Children will not be admitted to Eunoia without a signed informed consent agreement.

C2. The camper and the parent/guardians agree to abide by all policies and procedures, both written and verbal, set forth by Eunoia Forest School. All policies and procedures are available to families at any time by emailing ellisha@eunoiaforestschool.ca and providing a written request.

C3. The registrant shall reimburse Eunoia Forest School Inc. for any intentional damage or defacement done to camp property caused by the registrant's child.

D. REGISTRATION FEES, DEPOSITS, AND WAITLIST

D1. Any money paid toward registration and session fees are subject to a non-refundable deposit that is determined by the Owner/Operator, and based on the registered session. All session information can be found within the Parent Handbook and on our website at https://eunoiaforestschool.ca/programs-and-registration

D2. Due to fixed costs and expenditures based on definite enrollment, no refund or reduction in price will be given for arriving late or leaving early.

D3. The Owner/Operator of Eunoia Forest School, at her sole discretion, reserves the right to cancel an enrollment by giving notice of cancellation and refunding the amount paid.

D4. Payment is accepted by cash, credit card, or e-transfer.

If payment by these methods is not possible, please contact inquiry@eunoiaforestschool.ca for alternate arrangements.

D5. Fees are subject to change seasonally. You will be given at least 14 days notice of any fee changes.

D6. To complete your registration, you must:

a. pay your deposit within 24 hours of being offered a space.

b. pay the full program fee at least 21 days prior to your program start date.

c. If your enrollment start date is sooner than 21 days, full payment will be required

D7. If you cancel in writing 21 or more days prior to your program start date, we will provide a full refund, minus the $75 deposit.

D8. If you cancel in writing within 15-20 days of your program start date, we will refund 25% of your full payment.

D9. Fees are non-refundable 14 days prior to your program start date

D10. Within 24 hours of receiving your request, the Owner/Operator determines whether your request can be accommodated within capacity limits. If there is no space for your child, their name is placed on the waitlist.

D11. Registrations are accepted and children are placed on the waitlist in chronological order (e.g., based on the date and time requests are received).

E. PERSONAL BELONGINGS

E1. Eunoia Forest School is not responsible for a children's personal belongings, including articles of clothing that are lost or damaged at camp. It is highly recommended that children do not bring valuable and/or expensive clothing, jewellery, technology, and the like to Eunoia.

F. CUSTODY

F1. The parents/guardians submitting this form are those having legal custody over the child. Conditions of custody, if applicable, will be fully communicated in writing to Eunoia Forest School, including a photocopy of the section of any applicable court orders.

G. DUTY TO REPORT

G1. Every person in Ontario has a legal duty to immediately make a report directly to a children’s aid society (CAS) if they suspect that a child is, or may be, in need of protection. Section 125 of Ontario’s Child, Youth and Family Services Act, 2017 defines when a child is in need of protection (e.g., is or may be suffering from abuse or neglect) and indicates that a person may not rely on another individual to make a report on their behalf.

G2. Eunoia staff and volunteers, as professionals working closely with children, have a heightened legal responsibility to report suspicions of child abuse to a CAS, even if the abuse took place outside of Eunoia.

G3. The duty to report overrides all commitments to confidentiality; even relevant information disclosed during a privileged conversation will be reported to protect the safety of children.
