WAIVER AND RELEASE

I, the undersigned acknowledge that I am the parent or legal guardian of the child named

below who will be participating in any Toronto Athletic Camps Inc., TAC Aquatics Inc.,

TAC Academies Inc. (collectively "TAC"), Lifetime Skills Academy Inc. ("LSA"), or Strong

Play (“Strong”) activities or programs (collectively “Activities”).

I acknowledge and accept that a certain amount of risk, both known and unknown, is

associated with any such Activities which may result in any manner of illness, personal

injury or death and that by my child’s participation in any Activities, I the undersigned

unconditionally release, and forever discharge TAC, LSA, Strong, the owner or occupier

of any premises used in connection with any Activities, and each of their respective

affiliated entities, officers, directors, employees, agents, volunteers, chaperones,

representatives and any other person acting by, through, under or in concert with any of

such persons or entities, and their predecessors, successors, related companies and

assigns (collectively the “Releasees”), of and from any and all claims, actions, and causes

of actions, for any and all loss, damage, illness or injury, related to my child, including

death, and any person or entity claiming through my child, that may result from or occur

during and/or related to participation in the Activities, whether caused by the intentional

acts, negligence or carelessness of any person or entity, including but not limited to any

claims for negligence, negligent supervision, and/or negligent provision of medical care

and/or medication. This Waiver and Release extends and applies to, and covers and

includes, all unknown, unforeseen, unanticipated, and unsuspected injuries, damages,

loss and liability, and the consequences thereof, occurring in connection with and/or in

any way related to my child’s participation in the Activities at any time after the execution

of this Waiver and Release.

I warrant and represent that my child is physically, mentally and emotionally sound to fully

participate in the Activities and understand that the choice to participate brings with it the

assumption of those risks and results which are part of the Activities. I further agree to

advise TAC, LSA, and Strong of any and all relevant matters and any changes to such

matters in connection with my child’s participation in the Activities.

I hereby confirm, to the best of my knowledge, that my child is free from any contagious

or communicable illnesses. If there is a risk of illness I will notify and fully inform TAC,

LSA, and Strong staff immediately. I confirm that my child is physically able to participate

in the Activities. Prior to the start of any Activities I will fully disclose to TAC, LSA, and

Strong staff any and all medical issues had by my child that require care or supervision. I

agree that if my child should become ill or incapacitated TAC, LSA and Strong may take

any action it deems necessary for my child’s well being including securing medical

treatment and making any travel arrangements (both at my own expense). I understand

that in such instances I will not be entitled to any refund of paid Activities’ fees or costs

and that all liabilities associated with my child will be my responsibility.

Media

I grant permission to TAC, LSA, and Strong and any person or corporate entities or

affiliates acting on behalf of or through TAC, LSA, and Strong the right to use, reproduce,

and/or distribute photographs, films, video tapes and sound recordings of my child, for

use in materials they may create for purposes of promoting TAC, LSA, Strong and/or any

training or current or future marketing campaigns on TAC, LSA, and Strong’s website

and social media or for any legal purpose. I further waive my and my child’s rights to

inspect or approve finished images or electronic matter prior to publication and waive

compensation for their use. I agree that TAC, LSA and Strong can collect, use, disclose

and store personal information for the purposes of group events, collecting/processing

payments and emailing or mailing promotional/marketing material related to TAC, LSA,

and Strong’s business. I agree that I will not use any images or electronic matter relating

to my child’s participation in any Activity on any website or the internet without TAC, LSA,

and Strong’s express written permission.

Code of Conduct

I agree to comply with any TAC, LSA, and Strong rules, policies or conditions as advised

or posted. I understand that my child’s participation in any Activities is contingent on

complying with TAC, LSA and Strong’s rules, policies or conditions and that such

entitlement to participate can be voided, revoked, or suspended for any violation as

determined by TAC, LSA, and Strong in its sole discretion. I understand TAC, LSA and

Strong has a zero tolerance violence and bullying policy and any behaviour that places

my child or others at risk physically or emotionally (including harassment and/or bullying)

may result in immediate dismissal or removal from any Activities without refund, and I will

be responsible for all costs and liabilities associated with such dismissal or removal, all

of which is at the absolute discretion of TAC, LSA, and Strong. I further agree and

warrant that I am responsible for ensuring that my child fully comply with all of TAC, LSA

and Strong’s rules, policies or conditions.

Solicitation

I further agree and warrant that I approached TAC, LSA, and/or Strong for their services

based on my own volition and through any indirect or direct marketing, promotional and

or referral campaigns and I was not unduly influenced. I acknowledge that I was not

solicited by any members of TAC, LSA, or Strong other than through their marketing,

promotional and or referral campaigns and that I have selected the Activities based on

my own experience, research and needs.

Changes

In order to facilitate any of TAC, LSA, and Strong’s Activities whether for safety purposes

or reasons beyond TAC, LSA, and Strong’s control, I further acknowledge and agree that

TAC, LSA, and Strong reserves the right to amend or alter any Activities at any time

without compensation to participants, parents or guardians, that such amendments will

only be made in conditions that are beyond TAC, LSA, and Strong’s control and that it is

understood that due to the nature of the Activities certain circumstances could potentially

arise in the future.

Refunds

I acknowledge and accept that TAC, LSA, and Strong will not provide refund or credit for

any missed Activities for any reason whatsoever except in such cases where outdoor

Activities are cancelled by TAC, LSA and Strong due to inclement weather, in which case

credit will be provided as determined by TAC, LSA, and Strong in its sole discretion.

Miscellaneous and General

For any child of mine who is under the age of four and is participating in the Activities, I

acknowledge and understand this child care program is not licensed by the Government

of Ontario.

If any provision of this Waiver and Release shall be found to be unenforceable, a court

making such determination shall have the authority to narrow the provision, which shall

be enforceable in its narrowed form. Moreover, each provision is independent and

severable from each other, so in the event any portion is found unenforceable and not

modified, the remainder of the Waiver and Release shall remain in full force and effect.

I acknowledge the terms above by signing this document. I warrant that I have read,

understood and agree to all the contents of this document.
