CONDITIONS OF MEMBERSHIP

Members agree to abide by the policies and procedures of the YMCA of the Wabash Valley. All members are required to present a valid membership card for identification when using YMCA of the Wabash Valley facilities and programs. Membership to the YMCA is a privilege, and the YMCA reserves the right to cancel anyone's membership. Membership privileges and cards are not transferable, remain the property of the YMCA of the Wabash Valley, and must be returned upon request.

Please Note:

DRAFTS FOR YOUR MEMBERSHIP DUES WILL BE ISSUED MONTHLY. MEMBERSHIP DUES ARE NON-REFUNDABLE.
MEMBERSHIP RATES ARE SUBJECT TO CHANGE; NOTICE OF CHANGE IN MEMBERSHIP RATES WILL BE SENT OUT (BY MAIL OR EMAIL) 30 DAYS IN ADVANCE.
MEMBERSHIP DUES AND SIMILAR PAYMENTS ARE NOT DEDUCTIBLE AS CHARITABLE CONTRIBUTIONS.
A $30 RETRUNED PAYMENT FEE WILL BE ADDED TO YOUR ACCOUNT IF MEMBERSHIP DUES, PROGRAM DUES, AND/OR JOIN FEES ARE RETURNED DUE TO INSUFFICIENT FUNDS, FRAUD, ANY OTHER REASON THAT YOUR BANK DOES NOT PROCESS THE PAYMENT.
THE YMCA CONDUCTS REGULAR SEX OFFENDER SCREENINGS ON ALL MEMBERS, PARTICIPANTS, AND GUEST. IF A SEX OFFENDER MATCH OCCURS, THE YMCA RESERVES THE RIGHT TO CANCEL MEMBERSHIP, END PROGRAM PARTICIPATION, AND REMOVE VISITATION ACCESS.

ELECTRONIC FUNDS TRANSFER AUTHORIZATION I authorize my bank to honor pre-authorized drafts drawn by the YMCA on my account for membership payments and/or contributions. When the bank or credit card carrier honors the draft by charging my account, such drafts constitute my receipt for the payment. If at any time there is to be a change, deletion or cancellation of my membership, it is to be submitted in writing to the branch YMCA where membership was purchased, along with membership card(s) at least 10 days prior to bank draft date (using approved forms.) All amounts I owe to the YMCA must be paid upon termination and will remain owed until paid in full.

Participant Release & Waiver Liability and Indemnity Agreement

PLEASE READ CAREFULLY. THIS DOCUMENT EFFECTS YOUR LEGAL RIGHTS AND IS LEGALLY BINDING. BY SIGNING THIS AGREEMENT YOU ARE RELEASING YMCA OF THE WABASH VALLET FROM ALL LIABILITY AND FOREVER GIVING UP ANY CLAIMS THEREFORE

ASSUMPTION OF RISK

I acknowledge and agree that any use of YMCA of the Wabash Valley facilities, services, equipment and premises (“Facilities”) and any participation in YMCA of the Wabash Valley programs and activities (“Programs”) comes with inherent risks including, but in no way limited to: (1) moderate and severe personal injury, (2) property damage, (3) disability, (4) death, and (5) sickness or disease. I voluntarily accept and assume full responsibility for these risks as well as any and all other risks of the use of Facilities and participation in Programs. I agree that I have full knowledge of the nature and extent of all such risks and am not relying on all such risks being described in this document.

WAIVER, RELEASE & INDEMNIFICATION

In consideration of the use of Facilities and participation in Programs I, the undersigned, agree that YMCA of the Wabash Valley, it’s officers, directors, agents, employees, volunteers, insurers and representatives (“Releasees”) will not be liable for any personal injury, property damage, disability, death, sickness or disease incurred by myself, my family members, dependents, or guests, including minors, however occurring including, but not limited to the negligence of Releasees. I understand that I will be solely responsible for any loss or damage, including personal injury, property damage, disability, death, sickness or disease sustained from the use of Facilities and participation in Programs.

I further agree, on behalf of myself and any and all legal successors and proxies, to release and HEREBY DO RELEASE, WAIVE AND COVENANT NOT TO SUE Releasees from any causes of action, claims, suits, liabilities or demands of any nature whatsoever including, but in no way limited to, claims of negligence, which I and any and all legal successors and proxies may have, now or in the future, against Releasees on account of personal injury, property damage, disability, death, sickness, diseases or accident of any kind, arising out of or in any way related to the use of Facilities or participation in Programs, whether that participation is supervised or unsupervised, however the injury or damage occurs, including, but not limited to the negligence of Releasees.

In further consideration of the use of Facilities and participation in Programs, I agree to INDEMNIFY AND HOLD HARMLESS Releasees from any and all causes of action, claims, demands, losses, suits, liabilities or costs of any nature whatsoever, including claims of negligence, arising out of or in any way related to the use of Facilities and participation in Programs by myself, my family members, dependents or guests, including any minors.

I give my permission to the YMCA of the Wabash Valley to use, without limitation or obligation, photographs, film footage, or tape recordings which may use image or voice for purposes of promoting or interpreting YMCA programs.

ACCEPTANCE

I accept all terms and conditions of membership set forth in this Application and, understanding the Mission of the YMCA, hereby apply for membership. I understand that information given for my YMCA membership is the property of the YMCA and is kept as confidential.
