PAYMENT AUTHORIZATION

By providing your payment information and renting from City of Hurricane (“Owner”), you (“Renter”) authorize Owner to charge the specified payment method for all fees, costs, and related charges associated with your rental, including any late, damage, or rescheduling fees if applicable. You agree that you are responsible for maintaining accurate billing information and ensuring that any charges are honored by your payment provider.

LIABILITY STATEMENT FOR RENTALS

1. Acceptance of Risk
By renting from City of Hurricane (“Owner”), you (“Renter”) acknowledge and assume all risks associated with the use of the rented property, including but not limited to personal injury, property damage, or financial loss.

2. Waiver and Release
Renter hereby releases, waives, and forever discharges Owner and its affiliates, agents, employees, successors, and assigns from any and all liability, claims, demands, or causes of action arising out of or related to any loss, injury, or damage incurred while using the rented property, including negligence by Owner.

3. Indemnification
Renter agrees to defend, indemnify, and hold harmless Owner from and against any and all claims, demands, damages, losses, and liabilities (including attorney’s fees) arising out of or in connection with Renter’s use of the rented property.

4. Condition of Rental Property
Renter acknowledges that they have inspected (or have been given the opportunity to inspect) the rented property and have found it to be suitable for their intended use. Renter accepts the rented property “as is,” without any warranties, express or implied, regarding its condition or safety.

5. Compliance with Laws
Renter agrees to comply with all applicable federal, state, and local laws, ordinances, and regulations related to the use of the rented property, including but not limited to those of the State of West Virginia.

6. Governing Law
This Liability Statement shall be governed by and construed in accordance with the laws of the State of West Virginia. Any dispute arising out of this statement shall be brought in the appropriate court located in the State of West Virginia.

7. Acknowledgment and Understanding
By using the rented property, Renter acknowledges that they have read and understood the above terms, fully understand their rights and obligations, and voluntarily agree to be bound by these terms.

PHOTO/VIDEO RELEASE OF LIABILITY

1. Authorization and Consent
I, (“Participant”), hereby grant permission to City of Hurricane (“Owner”) to photograph, film, or record me (collectively, “Media”) in connection with Rentals. I further grant Owner and its representatives the right to use, reproduce, publish, distribute, and otherwise display such Media, in whole or in part, for any lawful purpose, including but not limited to marketing, promotions, advertising, and social media.

2. Waiver of Inspection and Approval
I waive the right to inspect or approve any final product incorporating the Media, including any written or electronic copy, and understand that I will not receive any notification, royalties, or compensation for such use.

3. Release from Liability
I release, waive, and forever discharge Owner, as well as its employees, contractors, officers, agents, and affiliates, from any and all claims, demands, damages, liabilities, and causes of action whatsoever, whether in law or equity, arising from or related to the use of the Media, including but not limited to any claims for defamation, invasion of privacy, or right of publicity.

4. No Financial Compensation
I understand that my participation is voluntary and that I will not receive financial compensation or any other consideration in exchange for the use of the Media.

5. Governing Law
This Release shall be governed by and construed in accordance with the laws of the State of West Virginia. Any dispute arising hereunder shall be brought in the appropriate court located in the State of West Virginia.

6. Acknowledgment
I confirm that I am at least eighteen (18) years of age and have the legal capacity to execute this Release. I have read this Release, fully understand its terms, and sign it freely and voluntarily.
