A. RENONCIATION AUX MÉDIAS

J'autorise l'organisation Sun Youth, ses dirigeants, agents et employés, les autres participants, les agences commanditaires, les annonceurs et, le cas échéant, les propriétaires et les bailleurs de locaux utilisés pour mener les activités ou les événements (les « renonciataires ») à recueillir le nom, la voix, les déclarations, la photographie, l'image, la ressemblance et les actions du participant, en tout ou en partie, à des fins promotionnelles, commerciales ou autres, à perpétuité dans le monde entier sur les médias standard et non standard de télévision, de vidéo, d'impression, électroniques et en ligne (y compris Internet) et dans tout autre moyen de distribution, de publication ou d'exposition, qu'ils soient connus ou créés ci-après sans contrepartie supplémentaire en rapport avec les renonciataires et le marketing, la publicité et la promotion de ceux-ci.

B. ACCEPTATION DE RISQUE

Je suis conscient que la participation du participant aux activités et événements comporte de nombreux risques, dangers et aléas, y compris, mais sans s’y limiter : les accidents sur ou à proximité du terrain, les accidents dans l’installation, le transport vers et depuis l’installation, la négligence des autres joueurs ou des autres parties participantes, la négligence de la part des renonciataires, y compris le défaut de protection contre les risques, dangers et aléas. J’accepte librement et assume pleinement tous les risques, dangers et aléas associés à la participation du participant aux activités et la possibilité de blessures corporelles, de décès, de dommages matériels ou de pertes en résultant. Je serai responsable de tous les frais et dépenses médicaux découlant, directement ou indirectement, de la participation aux activités en dehors de la couverture d’assurance fournie par l’adhésion nationale et provinciale à l’organisation Jeunesse au Soleil. Je comprends que si je sais ou soupçonne que ma condition physique peut être incompatible avec les activités, je dois consulter un médecin avant d’entreprendre lesdites activités.

C. EXONÉRATION DE RESPONSABILITÉ

En contrepartie de la participation du participant aux activités et de l’autorisation d’utiliser l’équipement et les installations de l’organisation Sun Youth, et pour toute autre contrepartie valable dont la réception et la suffisance sont reconnues, j’accepte ce qui suit :

DE RENONCER À TOUTE RÉCLAMATION que le participant a ou pourrait avoir à l’avenir contre les renonciataires et de LIBÉRER LES RENONCIATAIRES de toute responsabilité pour toute perte, dommage, dépense ou blessure, y compris le décès, que le participant pourrait subir ou que mon plus proche parent pourrait subir en raison de ma participation aux activités, quelle qu’en soit la cause, y compris la négligence, la rupture de contrat, la violation de toute obligation légale ou autre de diligence, y compris en vertu de la Loi sur la responsabilité des occupants de la part des renonciataires et en outre, Y COMPRIS LE DÉFAUT DE LA PART DES RENONCIATAIRES DE ME SAUVEGARDER ET DE ME PROTÉGER DES RISQUES, DANGERS ET DANGERS DES ACTIVITÉS. J'accepte de dégager de toute responsabilité et d'indemniser les Renonciataires de toute responsabilité pour les dommages matériels ou corporels causés à un tiers résultant de ma participation aux activités. J'accepte que le présent accord lie mes héritiers, mes plus proches parents, mes exécuteurs testamentaires, mes administrateurs et mes ayants droit en cas de décès. J'accepte que le présent accord soit régi et interprété conformément aux lois de la province de Québec et que tout litige impliquant les parties au présent accord soit porté au Québec. En concluant le présent accord, je ne me fie à aucune représentation ou déclaration orale ou écrite faite par les Renonciataires concernant la sécurité des Activités de basket-ball autres que celles énoncées dans le présent accord.

Je, soussigné, en tant que parent ou tuteur légal du Participant, reconnais et accepte le présent accord, comprends parfaitement ses termes et les droits auxquels j'ai renoncé en le signant, et le signe librement et volontairement sans aucune incitation.

A. MEDIA WAIVER

I grant permission to the Sun Youth Organization, their officers, officials, agents, and employees, other participants, sponsoring agencies, advertisers, and if applicable, owners and lessors of premises used to conduct the activities or events (the “Releasees”) to collect the name, voice, statements, photograph, image, likeness, and actions of the Participant, in whole or in part, for promotional, commercial, or other use, in perpetuity worldwide on standard and non-standard TV, video, print, electronic, and online media (including the internet) and in any other means of distribution, publication or exhibition, whether known or hereinafter created without additional consideration in connection with the Releasees and the marketing, advertising, and promotion thereof.

B. ASSUMPTION OF RISK

I am aware that the Participant’s involvement in the activities and events involve many risks, dangers and hazards including but not limited to: accidents on or near the court, accidents at the facility, transportation to and from the facility, the negligence of the other players or other parties participating, negligence on the part of the Releasees including the failure to safeguard and protect from the risks, dangers and hazards. I freely accept and fully assume all risks, dangers and hazards associated with the Participant’s involvement in the activities and the possibility of personal injury, death, property damage or loss resulting therefrom. I will be responsible for all medical costs and expenses following, directly or indirectly, from participation in the activities outside of the insurance coverage provided through the national and provincial membership in the Sun Youth Organization. I understand that if I know or suspect that my physical condition may be incompatible with the activities that I should seek medical advice before undertaking said activities.

C. RELEASE OF LIABILITY

In consideration, the Participant’s involvement in the activities and permitting the use of the equipment and facilities of the Sun Youth Organization, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I agree as follows:

TO WAIVE ANY AND ALL CLAIMS that the Participant has or may have in the future against the Releasees and to RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that the Participant may suffer or that my next of kin may suffer as a result of my participation in the activities, due to any cause whatsoever, including negligence, breach of contract, breach of any statutory or other duty of care including under the Occupiers Liability Act on the part of the Releasees and further, INCLUDING FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD AND PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIES. I agree to hold harmless and to indemnify the Releasees from all liability for property damage or personal injury to any third party resulting from my participation in the activities. I agree that this agreement shall be binding upon my heirs, next of kin, executors, administrators and assigns in the event of my death. I agree that this agreement shall be governed and interpreted in accordance with the laws of the Province of Quebec and any litigation involving the parties to this agreement shall be brought in Quebec. In entering into this agreement, I am not relying on any oral or written representation or statements made by the Releasees with respect to the safety of the Basketball Activities other than as set forth in this agreement.

I, the undersigned, as the parent or legal guardian of the Participant, acknowledge and agree to this agreement, fully understand its terms and the rights I have given up by signing it, and sign it freely and voluntarily without any inducement.
