PARTICIPANT WAIVER

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT
(hereinafter referred to as the “Release Agreement”)

TO: FENCINGCALGARY INC. (Fencing Calgary) and its directors, officers, employees, coaches, officials, instructors, agents, partners and partnership organizations, representatives, volunteers, independent contractors, subcontractors, sponsors, successors, lessors and assigns (hereinafter collectively referred to as the “Releasees”).

Fencing Calgary’s Programs are defined and include all multiple fencing related activities, including, but not limited to, the following:

Recreational & General Fencing Practice;
Competitive Fencing;
All Disciplines of Fencing (Foil, Epee & Sabre);
General fitness;
Fitness training for Fencing purposes;
Drop-in Sessions;
Birthday Parties;
Seasonal and Specialty Camps;
Special events; and
Similar activities

(Hereinafter collectively referred to as the “ACTIVITIES”).

ASSUMPTION OF RISK:

I/we do hereby acknowledge that not unlike many other sports, participation in fencing may Involve Inherent physical risks. I am aware that the ACTIVITIES involve inherent risks, dangers and hazards, both known and unknown, that are associated with unique movement patterns and skills. I understand that similar risks are also inherent in using equipment associated with the ACTIVITIES, and any other devices, apparatus or attractions present at the facility. I understand this includes risk of negligence on the part of the Releasees, including the failure on the part of same to take reasonable steps to safeguard or protect the participants from the risks, dangers and hazards, both known and unknown, of participating in the ACTIVITIES. I acknowledge that personal harm or injury may be sustained during me/my child’s involvement in the ACTIVITIES, including, but not limited to, exposure to any contagious or infectious diseases transmitted or contracted through any means whatsoever, broken bones, head / neck injuries, concussion, dislocations, tendon and ligament damage (including sprains), damage to teeth and dental work, internal injuries, puncture of skin or other tissues, bruises, strains, lacerations, spinal injuries (that could result in various degrees of paralysis), brain injury and death. I acknowledge and assume the potential risks and consent to my/my child’s participation in the ACTIVITIES. I/we also acknowledge that my personal actions/behavior may contribute to these risks and I accept responsibility to ensure my actions do not contribute to further risk of Injury to myself or other participants

CONSENT TO PARTICIPATION:

I/my child have/has been informed that I/he/she is to abide by the rules and regulations including directions and instructions from the administrators, instructors, coaches, and supervisors as imposed on me/my child while participating in the ACTIVITIES.
In the event that I/my child fails to abide by the rules and regulations imposed on me/my child while participating in the ACTIVITIES, disciplinary action may either require that I/he/she not participate in the ACTIVITIES, or that I will leave/be contacted to have my child picked up or transported home at my own expense.
I acknowledge that I/my child am/is in good health, and in proper physical condition to participate in the ACTIVITIES, and I acknowledge it is my responsibility to notify the staff of any physical or mental concerns for me/my child which may affect my/my child’s participation in the ACTIVITIES.
I acknowledge that the ACTIVITIES may require an instructor, coach, employee or supervisor to perform some manual movements / spotting which involves direct physical contact with me/my child and designed to assist the participant in the safe performance of the program skills, and I consent to same.

RELEASE OF LIABILITY AND WAIVER OF CLAIMS:

I confirm that I have read the above description of risks and understand the risks involved in participating in Fencing Calgary’s programming and ACTIVITIES. I confirm that I voluntarily and freely accept all such risks and choose to participate/allow my child to participate in Fencing Calgary’s programming and ACTIVITIES. I accept full responsibility for my own/my child’s actions.

In consideration of being allowed to participate in Fencing Calgary’s programming and ACTIVITIES, I hereby agree as follows:

TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES, and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I/my child may suffer, or that my next of kin or my child’s next of kin may suffer, as a result of my use/my child’s use of or my/my child’s presence in any Fencing Calgary programming or premises and ACTIVITIES DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.A. 2000, c. o-4 ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES THE FAILURE ON PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME/MY CHILD FROM THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE.

I further agree to the terms and conditions set under in Schedule “A” to this Release Agreement which is outlined below.

AUTHORIZATION OF FIRST AID IN CASE OF EMERGENCY AND INDEMNIFICATION OF COSTS:

I hereby authorize basic first aid to be delivered to me/my child by the Fencing Calgary staff or other authorities. By administering first aid when required or requested, Fencing Calgary in no way warrants or assumes any liability in relation to the administration of such basic first aid.

I further understand and agree that, in the case of an emergency, Fencing Calgary assumes no responsibility or obligation relative to any cost or expense related to carrying out an emergency procedure and/or emergency transportation for me/my child and I agree to pay for such costs and expenses and shall indemnify and reimburse Fencing Calgary for any such costs or expenses that it incurs. I confirm and agree that this Notification and Assumption of Risk, Consent to First Aid Treatment, and Release of Liability and Waiver of Claims shall be governed by the laws of the Province of Alberta. I confirm and agree that if any portion of this Notification and Assumption of Risk, Consent to First Aid Treatment, and Release of Liability and Waiver of Claims is found to be void and unenforceable, the balance, notwithstanding, shall continue in full force and effect.

I CONFIRM (BY CLICKING AGREE) THAT I HAVE READ AND UNDERSTAND THIS LEGAL AGREEMENT, I AGREE TO BE BOUND BY ITS TERMS, AND I AM AWARE THAT BY ACCEPTING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS AGAINST FENCING CALGARY INC. INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT.

AFFILIATION AGREEMENT

As a condition of my registration in, and participation in Fencing Calgary Programming I agree to become a PARTICIPANT / FAMILY BASE member in the following affiliated organizations AND to allow Fencing Calgary to register me, and remit my fee in the above membership categories on my behalf.

As a parent/guardian or participant attending Fencing Calgary ACTIVITIES, by clicking "I AGREE" I give consent for the purposes of information. Your contact information will be kept confidential and made available only to the staff of Fencing Calgary.

PHOTO/VIDEO RELEASE:

By clicking AGREE below, I AGREE to give permission to Fencing Calgary to take pictures or video of me/my child during my/their participation in any program, and that these may be used for advertising, organization noticeboard, website, and any social media platform. I am of the understanding that my child’s full name WILL NOT appear in relationship to any photographs or videos without additional written consent.

I also AGREE to give permission to Fencing Calgary to take pictures or video of me/my child during my/their participation in any program, and that these may be used for training purposes.

*Note: should you chose, you can withdraw your consent in written notice at any time.

EMAIL COMMUNICATION:

By clicking AGREE, I provide my consent to receive information, news and updates from Fencing Calgary via email. I understand that I will have the option to unsubscribe at any time.

REGISTRATION POLICIES

All registrations must be made on Fencing Calgary’s website directly through Amilia. A Program Coordinator will assist if required.
A participant may join at anytime during the year (fees pro-rated to start date).

PAYMENT POLICY

Payment is required prior to the start of ALL Fencing Calgary course sessions, activities, and events.
In the event of delinquent accounts or unpaid fees; participant families will be notified to bring their account to good standing or discontinue participation.

In special cases a paper cheque or E-transfer may be accepted – please contact Fencing Calgary
GST (5%) is NOT included in pricing unless otherwise stated
Payments with INSUFFICIENT FUNDS (NSF) are subjected to a $30 administration fee. FAILURE TO MAKE PAYMENT PRIOR TO THE START DATE WILL RESULT IN CANCELLATION OF THE REGISTRATION(S)

PAYMENT OF MEMBERSHIPS & INSTALLMENT PAYMENTS

Installments are NOT accepted for payment of the following programs: LEARN, PARTICIPATE, PRACTICE & PLAY
Memberships and Installment payment details at TRAIN, IMPROVE & COMPETE levels are detailed in the individual program registration.

GENERAL CANCELLATION, WITHDRAWAL & REFUND POLICIES

All course sessions, events & activities are non-refundable as of 10 days prior to the start date of the activity.
All Fencing Calgary memberships are non-refundable as of the date of purchase.
All Affiliations collected and remitted by Fencing Calgary to other sport governing bodies are non-refundable as of the date of purchase.
Course / event & activity cancellation PRIOR to the 10 day period in advance of the start date may be refunded (less a $30 administration fee per cancellation) OR granted a credit towards other Fencing Calgary courses or events upon written request.
Fencing Calgary reserves the right to cancel any program(s) with insufficient registration ONE WEEK prior to program start date. If Fencing Calgary cancels your class due to enrollment or scheduling issues, we will transfer you to the next available class of your choice. If we can not find a comparable and convenient alternative option, you will receive a full refund with no additional administrative fees.
In-session course withdrawal due to injury (a doctors note must accompany written notice) may be granted a pro-rated credit for further Fencing Calgary courses / events.
If you/your family are not completely satisfied after your first day, Fencing Calgary will refund your full session tuition. We strive to create an exceptional experience and we hope that we can exceed your expectations. Please note: mandatory program equipment is non-refundable upon purchase.
AFTER YOUR FIRST CLASS, Fencing Calgary maintains a NO REFUND policy on all of our fees, memberships and other events and offers in order to ensure proper safety and staffing for our activities and events.
After the first class of the session, refunds are issued for medical reasons ONLY and a medical certificate or doctor’s note must be provided. Medical cancellations will receive a pro-rated refund (less a $30 administration fee per cancelation) or a pro-rated credit can be applied to your account for future use (with no additional administrative fees). Please note: mandatory program equipment is non-refundable upon purchase.
Class change/transfers are based on availability and must be approved by Program Management. Please contact us for more information. Please also see the Class Change/Transfers section below.
All mandatory program equipment at the LEARN+ program levels is non-refundable.

WEATHER, HOLIDAYS & PROGRAMMING CLOSURE POLICIES

A schedule of closure due to statutory holidays is built into the cost structure and outlined in the registration information of all programs.
Activity fees do not include holiday’s and other outlined ‘official’ closures
Fencing Calgary will hold all activities unless otherwise notified.
Families will be emailed in the event of closings in case of inclement weather.
If Fencing Calgary cancels an activity, families will be responsible for to arrange their own make-up class, by emailing Fencing Calgary. In the event of multiple cancellations (4 or more), make-up classes will be scheduled by Fencing Calgary. Please note: No credit will be given for weather cancellations.
Fencing Calgary closures due to extreme circumstances such health & safety or other crisis: credit, suspension of fee payments or refund will be planned on a case by case basis at the discretion of Fencing Calgary. All members, participant families will be informed of the individual processes as soon as possible in this case.

MAKE-UP CLASSES, CANCELLATION & TRANSFER POLICES

Refer to the Policies section on the home page of the Fencing Calgary Website or under each Program section.

EQUIPMENT POLICY - GENERAL

Fencing Calgary is NOT responsible for lost, stolen or left behind personal property.
Staff are not permitted to accept responsibility for personal articles.
Participants will provide and wear appropriate, clean, athletic indoor (separate from outdoor) foot ware during all activities
Participants will wear appropriate athletic attire for activity (no jeans, street cloths etc.)
Certain programs require certain mandatory pieces of equipment – families ARE RESPONSIBLE FOR PROVIDING THE APPROPRIATE MATERIALS BASED ON THEIR LEVEL OF PARTICIPATION.
All required fencing equipment will be provided to participants for THE FIRST 1-10 WEEKS of participation ONLY
FOR THE HEALTH & SAFETY OF ALL PARTICIPANTS FENCING SPECIFIC EQUIPMENT WILL BE RENTED TO THE PARTICIPANT FOR THE DURATION OF THEIR 8-10 WEEK PROGRAM
A RENTAL FEE WILL BE CHARGED TO ALL PARTICPANTS RENTING (NOT OWNING) PERSONAL EQUIPMENT
FAILURE TO RETURN RENTAL EQUIPMENT BY THE OUTLINED DATE WILL RESULT IN THE PARTICIPANT FAMILY BEING BILLED THE OUTLINED COST OF THE EQUIPMENT AS OUTLINED IN THE RENTAL AGREEMENT
Returning and ongoing participants are expected to provide their own STARTER EQUIPMENT SET after 8-10 weeks of participation is completed (see website for the purchase of personal equipment)
Participant families will be billed for breakage of any club equipment or rental equipment
IN CERTAIN CASES - FOR HEALTH & SAFETY OF PARTICIPANTS - FAMILIES WILL BE REQUIRED TO PROVIDE OR RENT COMPLETE PERSONAL GEAR – this supersedes the above points and will be implemented in health & safety related circumstances.

SUPERVISION, BEHAVIOUR & CHILD PROTECTION POLICIES

PICK UP / DROP OFF POLICIES

Participants are NOT supervised by Fencing Calgary staff outside of outlined activity times.
Fencing Calgary is NOT RESPONSIBLE FOR UNSUPERVISED PARTICIPANTS (REGARDLESS OF AGE) OUTSIDE OF OUTLINED ACTIVITY TIMES.
Families leaving unsupervised participants at any activity may be removed from program participation without refund.

PROGRAM BEHAVIOURAL ISSUES / EXPULSION POLICIES

Participants and/or families will be informed of behavioural issues during activities that are problematic or dangerous. It is expected this be addressed by the participant / family.
A participant may be expelled without refund if their behaviour is dangerous abusive to classmates or staff or contravenes Fencing Calgary code of conduct.
A participant may be expelled for destruction of equipment or the property of others.

CHILD PROTECTION POLICIES

All staff must complete the National Coaching Certification Program Course ‘Making Ethical Decisions’
All staff must undergo a vulnerable sector Police Criminal Record Background Check
Profane and degrading language is prohibited
Bullying, abuse of any kind and violence is prohibited
Threatening or intentionally inflicting physical injury is prohibited
Committing any sexual offence against a minor or engaging in sexual contact with a minor is prohibited
The organization has a zero-tolerance policy for non-related one-adult/one-child interaction

Health & Safety Protocols

PLEASE REFER TO THE HEALTH & SAFETY PROTOCOLS SECTION OF THE WEBSITE
Parents and Participants must inform themselves and follow outlined protocols, guidelines & procedures of Fencing Calgary partner facilities & organizations (Alberta Fencing & Canadian Fencing Federation), including City of Calgary run facilities.
All above procedures are superseded by those of the Provincial Government and Public Health Authorities.
Parents should check their email to stay abreast of any possible developing changes or important health information.

HEALTH & SAFETY DECLARATION – FENCING CALGARY

I hereby declare (by Clicking AGREE) that I, or anyone in my household, has not experienced any cold or flu-like symptoms in the last 7 days (including fever, cough, sore throat, respiratory illness, difficulty breathing). If I, or anyone in my household, experiences any cold or flu-like symptoms after submitting this declaration, I will then not attend any activity, program or service for a minimum period of 7 days after the cold or flu-like symptoms have completely gone away.
