The rare Charitable Research Reserve (“rare”) Camp Store hosted on the Amilia platform is an information and communications service (the “Camp Store”). Access and use of this Camp Store is governed by the terms and conditions provided below in the User Agreement. Please read the User Agreement carefully.

BY ACCESSING AND USING rare’s CAMP STORE, YOU ARE AGREEING TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THE USER AGREEMENT.

Disclaimer

The Camp Store is provided on an “as-is” and “as-available” basis. This User Agreement is subject to change without notice. rare makes no warranties or representations that the Camp Store, including its content, information, products or services or other material available through the Camp Store, will be provided on an uninterrupted, timely, secure or error-free basis.

Limitation of Liability

Under no circumstances will rare be liable for any damages relating directly or indirectly to any action or inaction based on the content, information, products or services or other material available through the Camp Store. rare will not be responsible for any damages or losses related to, the accuracy, currency or completeness of the content, information, products or services or other material obtained through the Camp Store.

Indemnification

You agree to indemnify, defend and hold harmless rare, its ministries, affiliates, its governing board, officers, agents, employees, volunteers, partners, donors, funders and suppliers from any liabilities, losses, claims, demands, and expenses (including reasonable lawyer’s fees) related to (a) your use of the Camp Store; or (b) violations of these Terms of Use.

Intellectual Property

rare owns all rights, including all copyright, in the entire content of the Camp Store. Unless otherwise indicated, no right, title or interest is granted in the content, information, products or services or other materials available through the Camp Store.

rare logos, including logos for its various ministry areas, are all trademarks of rare.

The names of all other products and services mentioned on rare’s Camp Store are the trademarks or trade-names of their respective owners.

The display of trademarks or trade-names on this Camp Store does not convey or create any license or other rights in these marks or names.

You may not use rare trademarks without the prior written consent of rare Charitable Research Reserve.

Limited Use

rare grants you a limited license to download and display on your computer monitor, or hard copy prints, the Camp Store’s content, for non-commercial, personal or educational purposes only, providing that the Camp Store content is not modified and that the Camp Store’s copyright statement and this limited license are included with, and displayed on, each printed copy of such content. The following limitations apply to the use of the Camp Store:

You may not:

use the Camp Store’s content for commercial purposes;
include the Camp Store’s content with any product or service that you or your agents create or distribute, including software or other digital products; and
display the Camp Store’s content on any other website or make available the Camp Store’s content on any file server.

Copyright

Nothing contained in the license granted under the limited use clause shall be construed as conferring any right under any copyright of rare or any other person who owns the copyright.

All information on the Camp Store is protected by copyright, pursuant to Canadian copyright laws, international conventions, and other copyright laws. All rights reserved. Any reproduction, modification, publication, transmission, transfer, sale, distribution, display or exploitation of the information, in any form or by any means, or its storage in a retrieval system, whether in whole or in part, without the express written permission of rare Charitable Research Reserve is prohibited.

Third Party Information

Third parties may provide information displayed on the Camp Store. The third-party information displayed on the Camp Store is not necessarily sponsored, endorsed, recommended, or licensed by rare. The third-parties ought to be contacted directly regarding any inquiries or for more information on their website policies.

Third Party Links

The Camp Store may provide links to other Internet sites. rare has no control over such sites. rare does not endorse nor is it responsible for, any such sites or the information, material, products or services contained on or accessible through those other Internet sites.

Termination

rare may at its sole discretion, with or without notice, suspend or terminate your use of the Camp Store for any reason, including a violation of the terms of the User Agreement. rare may also prevent you from further use of the Camp Store. rare will not be liable for any suspension, termination or prohibition of future access.

Governing Law

This User Agreement is governed by the law of the Province of Ontario and the laws of Canada.
