Terms and Conditions

By creating an account, registering for programs, purchasing memberships, or booking facilities through the Town of Rosthern Recreation Portal, you agree to the following Terms and Conditions.

1. Acceptance of Terms

The Town of Rosthern reserves the right to amend these Terms and Conditions, fees, policies, and procedures at any time without notice. Continued use of the Recreation Portal constitutes acceptance of any changes.

2. Account Responsibility

Users are responsible for maintaining accurate account information, including contact details, emergency contacts, and payment information.

Account holders must be at least 18 years of age to create an account or make purchases. Parents or legal guardians are responsible for registrations and purchases made on behalf of minors.

3. Registration and Bookings

Program registrations and facility bookings are accepted on a first-come, first-served basis unless otherwise noted.

Submission of a booking request does not guarantee approval or availability. Certain facility rentals may require Town staff review and confirmation before a reservation is finalized.

The Town reserves the right to refuse or cancel any registration or booking that violates Town policies or exceeds facility capacities.

4. Fees and Payment

All fees are payable at the time of registration or as otherwise specified by the Town.

Applicable taxes, service charges, and processing fees may be added to transactions.

The Town accepts payment methods available through the online booking platform.

Failed or declined payments may result in cancellation of registrations, memberships, or facility reservations.

5. Refunds and Cancellations

Refund and cancellation policies vary by program, membership, and facility.

Unless otherwise specified:

Administrative fees may apply to cancellations or transfers.
No refunds will be issued after a program has commenced unless approved by the Town.
Facility booking deposits designated as non-refundable will not be refunded.

6. Program and Facility Changes

The Town of Rosthern reserves the right to:

Cancel programs due to insufficient registration.
Change instructors, schedules, locations, or program content.
Reschedule activities due to weather, facility issues, emergencies, or circumstances beyond the Town's control.
Limit enrolment when necessary.

In the event of a Town-initiated cancellation, participants may receive a credit, transfer, or refund as determined by the Town.

7. Code of Conduct

All participants, spectators, parents, coaches, and facility users must conduct themselves in a respectful manner.

The Town reserves the right to remove or deny participation to any individual whose behaviour is disruptive, unsafe, abusive, discriminatory, or contrary to Town policies.

Individuals removed from programs or facilities due to misconduct may not be eligible for a refund.

8. Facility Use

All facility users must comply with posted rules, staff directions, municipal bylaws, and applicable provincial regulations.

The renter or account holder is responsible for the actions of their participants, guests, spectators, and invitees.

Any damage to Town property or equipment caused by a user or their group may result in repair or replacement charges.

9. Assumption of Risk

Participation in recreational programs, activities, and facility use involves inherent risks, including the risk of personal injury, illness, property damage, and other hazards.

Participants voluntarily assume all risks associated with participation and facility use.

Parents or guardians assume these risks on behalf of minor participants.

10. Release of Liability

To the fullest extent permitted by law, the Town of Rosthern, its Council, employees, volunteers, contractors, and agents shall not be liable for any injury, loss, damage, expense, or claim arising from participation in programs, activities, or facility use, except where caused by the Town's gross negligence or willful misconduct.

11. Personal Property

The Town of Rosthern is not responsible for lost, stolen, or damaged personal property brought to any facility, program, or event.

12. Privacy

The Town of Rosthern is committed to protecting personal information in accordance with applicable privacy legislation.

Information collected through the Recreation Portal will be used for program administration, facility bookings, communication, payment processing, safety purposes, and municipal record-keeping.

13. Photography and Promotional Materials

The Town of Rosthern may photograph or record activities, programs, and events for promotional, educational, or informational purposes.

Individuals who do not wish to appear in promotional materials should notify Town staff in writing prior to participation.

14. Governing Law

These Terms and Conditions shall be governed by the laws of the Province of Saskatchewan and the laws of Canada applicable therein.

15. Agreement

By checking the acceptance box, creating an account, registering for a program, purchasing a membership, or completing a booking, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
