Sunnyside Paddling Club Terms & Conditions
When using our facility and related services you and any participants agree to the Terms & Conditions (“Terms”). For the purposes of these Terms, the following definitions apply:

Participant: An individual who actively engages in activities on premise and services provided off-premise.
Sunnyside Paddling Club “SPC”: Staff, Contractors working in capacity for the facility, Board of Directors
Premises: Includes all leased areas within the Sunnyside Pavillion area, Outdoor storage compound and watercraft docks

Sunnyside Paddling Club (SPC) is a not-for-profit organization dedicated to using paddle sports as a vessel to improve the lives of everyone. SPC was founded in 2005 primarily to promote the sport of dragon boat racing. Since then, the club has grown to provide services and access for over 2000 users to a wide variety of different paddle craft within the Greater Toronto Area and beyond.
The individual acting as the group organizer and booking a facility rental on behalf of other Participants (the "Group Organizer") shall bear sole responsibility for communicating all relevant information, terms, and requirements related to participation in the facility rental to the members of their group. The Group Organizer further warrants that all Participants within their group meet the eligibility criteria and any requirements for participation as established by SPC.
By entering SPC premises or engaging in any Sunnyside activities or services, you agree to abide by these Terms, which are designed to ensure a safe, respectful, and enjoyable environment for all.

1. Mandatory Waiver and Agreement
I.   All Participants must assess their own abilities and decide if they are comfortable and capable of participating safely in activities or services provided by SPC
II.   Participants aged 18 or older must read, sign, and submit an adult waiver before entering the premise
III.   For Participants under 18, a legal parent or guardian must complete the waiver on their behalf.
IV.   Waivers are included in booking confirmation emails and are available on the Sunnyside website
V.   Additional waivers may be required for specific activities

2. Payment, Refund & Cancellation Policy
Dragon Boat Rentals
I.   A non-refundable deposit of 10% is required on booking or greater as agreed upon in the invoice
II.   Full payment is required no later than one-week prior to the first session or as agreed to with SPC
III. Changes a week in advance - full-refund less administrative fee, if less than a week but more than 24 hours - credit to be used within the season, less than 24 hours - no refund or changes permitted
IV.   In the event of damage to property, participant hereby agrees to refund SPC for its replacement cost and total balance outstanding. Participant will make the payment prior to departing or, should this be deemed impossible by both parties, within (1) one week of receiving appraisal and/or invoice for repair or replacement of damaged property sent by SPC.

Memberships, Classes and Youth Day program
I.   Fees are payable immediately at time of sign-up
II.   Changes/cancellation of membership or program fees must be completed 14 days prior to the start of the class or membership term
III.   No refunds or changes are permitted after the first class or start of the term unless authorized by SPC
IV.   All refunds are subject to an admin fee of $10

Inclement Weather
All of the above programs are rain or shine will run unless it is deemed unsafe by SPC
In the event of weather or other adverse events impacting the usage of the facility a credit or refund of the session within the paddling season April 1 to October 31 will be provided at the discretion of the SPC

Corporate and one session events
I.   A non-refundable deposit of 10% is required on booking or greater as agreed upon in the invoice
II.   Full payment is required no later than one-week prior to the first session or as agreed to with SPC
III.   All fees are non-refundable
IV.   Events have a lower threshold of adverse weather cancellations as safety and additionally a comfortable enjoyable environmental experience is also a consideration, SPC will work with event organizers to determine what works best for both parties and will cancel or modify the event no later than 3 hours prior to the session start and preferably the day before
V.   In the event of inclement weather or adverse events impacting the usage of the facility a credit or refund will be provided within one-week of the session date

Administrative Fees
All fees refunded are subject to an admin fee of the greater of $5 or 6% unless otherwise specified

3. Terms, Renewal and Duration
Memberships, Classes and Dragon boat rentals
This agreement commences and ends on the dates specified in your invoice

4. Equipment
All users of the facility must be versed in the safe usage of the equipment provided by the facility, improper use of such equipment absolves the facility of any and all liability

5. Personal Health and Medical Conditions

Participants are responsible for assessing their abilities and health before participating in activities or services provided by SPC. By choosing to participate, they affirm that they are in suitable physical and mental condition and possess requisite skills to engage in the activities. Participants must inform staff of any relevant medical conditions that could affect their ability to participate safely. Furthermore, Participants agree to hold SPC harmless for any injuries, complications, or adverse events resulting from disclosed or undisclosed medical conditions or health issues.

6. Readiness
Please plan your transportation accordingly namely be aware of various special events, construction and traffic. Participants should target arrival at least 30 minutes prior to the start of their programming to allow for parking, walking to the site, changing etc;
Late arrivals may result in forfeiting booking without recourse.
All equipment must be returned on-time, participants should ensure they have a device capable of measuring time and monitor it to avoid late-fees.

7. General Conditions

Participant agrees:
I.   to abstain from smoking inside the PREMISES, since PREMISES is a smoke-free environment; smoking on the premises will be considered a violation on the rental agreement and result in immediate forfeiture of the security deposit;
II.   to restrict all animals from the PREMISES;
III.   to ONLY allow PREMISES access to the PREMISES to individuals that are members of the participants team
IV.   to leave the property in a reasonably clean state after each use;
V.   to ensure all clients and participants understand and adhere to facility rules
VI.   to notify the facility if the media are invited to the event. The media must not interview, photograph or film facility staff or other facility users without consent.
VII.   SPC is not liable or responsible for any lost, stolen or damaged property on the premises.
VIII.   Emergency communications: Participants are required to maintain a reliable means of contacting SPC, such as a personal cell phone, in the event that a pickup or rescue is necessary. While SPC will endeavor to assist Participants in such situations, it does not guarantee retrieval services under all circumstances and assumes no liability for delays or failures to provide such assistance.
IX.   Right to refuse service: SPC reserves the right to refuse service due to safety or behavior issues
X.   Supervision of minors: Parents or guardians are responsible for supervising minors at al times unless participating in designated supervised activities such as our youth day camp
XI.   Rules of the Waterways: SPC is a member of the West End Beaches Stakeholders Association (WEBSA) which is a coalition formed in 2005 by the Argonaut Rowing Club, The Boulevard Club, Sunnyside Paddling Club, and Toronto Sailing & Canoe Club to work with government agencies and non-governmental organizations to address the interests of persons who regularly use Toronto’s western beaches waterfront and waterways. We like our neighbors, so please share the water respectfully. Ensure you stay to the right of our waterway and are actively engaged in giving way to faster craft and respecting the maneuvering of powered craft returning or departing their docks at neighboring clubs, please review the more detailed rules of the waterway on our website
XII.   Adhere to regulations of Transport Canada
XIII.   Any violation of the conditions stated above will result in the immediate void of this agreement

8. Liability and Assumption of Risk
The participant acknowledges that all activities and/or programs performed at Afterburn Fitness shall be at my own risk and hereby release and discharge the facility, its owner(s), officers, directors, agents and employees from any liability, claims, demands, injury, damage, action or cause of action whatsoever, which may result from the use of services or facilities of the facility on the premises where the same or any and all acts of the facility are rendered.
