ASSUMPTION OF RISK LIABILITY RELEASE, INDEMNIFICATION, REFUND POLICY STATEMENT AND PHOTOGRAPH/IMAGE USE STATEMENT

1. RELEASE AND INDEMNIFICATION: I hereby recognize and acknowledge that participation in recreational activities or use of the District facilities may involve bodily and or emotional injury to me and or my child/dependent. In consideration of being permitted to participate in such events, I, as a participant, and/or as a parent or legal guardian of a participant, my heirs, my executors and administrators, hereby voluntarily and knowingly indemnify and hold harmless, defend and release waive and discharge the Oquirrh Recreation and Parks District (District), the Utah Olympic Legacy Foundation (UOLF), and its officers, employees, and volunteers from any and all suits, claims or liability, based on any injury except that caused solely by the willful misconduct of the District and/or UOLF, that may result from participation in the District and UOLF's activities or use of facilities. In addition, I agree that I or my insurance company will pay for medical, hospitalization or any other expenses resulting from participation.

2. EMERGENCY TREATMENT: I hereby authorize the District and UOLF's staff to act on my behalf in accordance with their best judgment in case of an emergency involving myself (and/or my child/dependent, as applicable), and agree to assume full responsibility for all expenses, medical or otherwise that may arise therefrom. I understand that I or my insurance company will pay for such emergency treatments.

3. DAILY ADMISSION REFUND POLICY: There are no refunds for daily admission.

3. PROGRAM REFUND POLICY: All refunds processed at the request of the patron or for circumstances beyond our control will be assessed a $10 administration fee. Refunds will be issued within thirty (30) days upon discussion and approval. Refunds or credits will be offered up to the first week of program minus any time used.

4. MEMBERSHIP REFUND POLICY: There is a thirty (30) day grace period to cancel a monthly membership. No refund will be available on a monthly membership that is cancelled within the 30 day grace period. Monthly membership will be cancelled immediately with no penalty. For annual memberships, there is a thirty (30) day grace period to receive a prorated membership refund minus a $25 service fee. Please allow up to thirty (30) days for the refund to be processed.

4. PHOTOGRAPH/IMAGE USE: I hereby grant permission to the District the right to use my (and/or my child/dependent’s) photograph, image, video or likeness while participating in a District program, activity or facility use, on informational and promotional materials and reports, in printed, video and electronic (web) form, without any obligation or liability to the District, the minor child or the child’s parent or legal guardian.

5. I (we) agree to follow the rules and regulations set by the District, its representatives, successors and assigns.

6. By agreeing to this assumption of risk liability release, indemnification, refund policy statement and photograph/image use statement, I acknowledge that I have read its contents and disclosure, that I understand its contents and disclosure and that I agree to its terms.

CONCUSSION AND HEAD INJURY POLICY

PURPOSE:

In compliance with the Protection of Athletes with Head Injuries Act, Utah Code Ann. Title 26, Chapter 53 (the “Act”), the Oquirrh Recreation and Parks District (“District”), has adopted this concussion and head injury policy (“Policy”) to require adherence by all District agents, as defined in the Act, including coaches and volunteers, and also by parents, legal guardians, and children under the age of eighteen (18) years (individually a “child”) who participate in any KOPFC sporting event.

DEFINITIONS:

Statutory Definitions. The definitions stated in Utah Code Ann. § 26-53-102 are incorporated by reference as part of this Policy.

Concussion/Traumatic Head Injury. A “traumatic head injury” is an injury to the head arising from blunt trauma, an acceleration force, or a decoration force. As used in this Policy, “concussion” shall include any “traumatic head injury”. A concussion is a brain injury, and all brain injuries are serious. They are caused by a bump, blow, or jolt to the head, or by a blow to another part of the body with the force transmitted to the head. They can range from mild to severe and can disrupt the way the brain normally works. Even though most concussions are mild, all concussions are potentially serious and may result in complications, including prolonged brain damage and death, if not recognized and managed properly. You may not see a concussion, and most sports concussions occur without loss of consciousness. Signs and symptoms of a concussion may show up right after the injury or may take hours or days to fully appear.

Concussion Symptoms. Symptoms may include one or more of the following: headaches, sensitivity to light or noise, “pressure in head”, becoming more emotional, nausea or vomiting, “don’t feel right”, fatigue or low energy, neck pain, sadness, balance problems or dizziness, nervousness or anxiety, blurred, double, or fuzzy vision, irritability, feeling sluggish or slowed down, confusion, feeling groggy or foggy, concentration or memory problems, drowsiness (forgets game being played), change in sleep pattern, repeating the same question/comment, and/or amnesia.

Observed Signs of a Concussion. Signs of a concussion observed by participants, parents, coaches and others may include: The person appears dazed, can’t recall events prior to the contact, vacant facial expression, can’t recall events after the contact, confused about assignment, slurred speech, loss of consciousness, moves clumsily or displays lack of coordination, shows behavior or personality changes, seizures or convulsions, is unsure of game, score, or opponent, and/or answers questions slowly.

Sporting Event. For purposes of this Policy, a “sporting event” means any athletic activity that is organized, managed or sponsored by the District, including a game, practice, sports camp, competition, class or try out. “Sporting event” does not include any situation where the District merely makes a field, facility, or other location owned, leased or controlled by the District available to an amateur sports organization or a person, regardless of whether the District charges a fee for the use – examples include open swim, open gym or a day pass.

POLICY:

If a person reports any symptom of a concussion, or if any symptom or sign of a concussion is noticed, the person must immediately be removed from the sporting activity and medical attention should be sought. Continuing to participate with the signs and symptoms of a concussion leaves the person especially vulnerable to greater injury. There is an increased risk of significant damage from a concussion for a period of time after the concussion occurs, particularly if the person suffers another concussion or traumatic head injury before completely recovering from the first one. This can lead to prolonged recovery, or even to severe brain swelling (second impact syndrome) with devastating and even fatal consequences. It is well known that adolescent or teenage participants in sporting events will often under-report symptoms of injuries. Concussions are no different. As a result, education of administrators, coaches, parents and participants is the key to a person’s safety.

Distribution of Policy. A copy of this Policy will be provided to each District agent and, before the person will be permitted to participate in a District sporting event, to a parent or legal guardian of any child desiring to register and/or participate.

Agreement Required. The signature of a participant or parent or legal guardian of a child, acknowledging that the person or parent or legal guardian has read, understands and agrees to abide by this Policy, must be provided to the District before the participant will be allowed to participate in a District sporting event.

Suspension of Participation. Any participant who is suspected of suffering a traumatic head injury or concussion will immediately be removed from the sporting event. No child may return to the activity after an apparent traumatic head injury or concussion, regardless of how mild it may seem or how quickly symptoms clear, without a written medical clearance stating that the child has been evaluated by a qualified health care provider, licensed under Utah Code Ann. Title 58, who may evaluate and manage a concussion within the health care provider’s scope of practice and is trained in the evaluation and management of a concussion. The written release signed by the qualified health care provider must state that: “(A) the qualified health care provider has, within three years before the day on which the written statement is made, successfully completed a continuing education course in the evaluation and management of a concussion; and (B) the child is cleared to resume participation in the [District] sporting event”. Utah Code Ann. § 26-53-301(1)(b).

Parent’s or Guardian’s Responsibility. Parents/guardians are expected to inform their child’s coach or another responsible District agent if they think or suspect that their child may have a concussion or a traumatic head injury and to immediately seek medical attention for the child.
