RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

DESCRIPTION OF RISK:

I acknowledge that as in any sport, in diving there exists the possibility of serious injury to or death of participants. The risks, dangers and hazards include, but are not limited to, injuries from:

Executing strenuous and demanding physical techniques;
Vigorous physical exertion, strenuous cardiovascular workouts and rapid movements;
Exerting and stretching various muscle groups;
Failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment;
Contact, colliding, falling or being struck by other participants or equipment;
Spinal Cord injuires which may render me permanently paralyzed; and
The hazards particular to the activity(ies) in which I am participating

Furthermore, I am aware:

That injuries sustained can be severe;
That my child may experience anxiety while challenging themselves during the activities, events and programs;
That my child may come into close contact with other participants;
That my child's risk of injury is reduced if they follow all rules established for participation; and
That my child's risk of injury increases as they become fatigued

I hereby release, waive and forever discharge Ottawa National Diving Club, Dive Ontario and their members, Directors and employees against any and all claims against howsoever caused, arising as a result of or in any way connected with participant's activity. An annual insurance fee is required (members only) / included (Learn to Dive program only) upon registration, that is valid for one full year.

RELEASE OF LIABILITY AND DISCLAIMER:

In consideration of the Ottawa National Diving Club allowing an athlete to participate, he/she agrees:

The sole responsibility for the participant's safety remains with the participant;
To remove oneself if sensing or observing any unusual hazard or unsafe conditions; or feel unable or unfit to safely continue;
To ASSUME all risks arising out of, associated with or related to his/her participation;
To WAIVE any and all claims that he/she may have now or in the future against the Ottawa National Diving Club;
To freely ACCEPT AND FULLY ASSUME all such risks and of personal injury, death, property damage, expense and related loss, including loss of income, resulting from his/her participation in the activities, events and programs of the Ottawa National Diving Club; and
To FOREVER RELEASE the Ottawa National Diving Club from any and all liability for any all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the "Claims") which he/she may have or may in the future, that might arise out of, result from, or relate to his/her participation in the activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Ottawa National Diving Club.

REFUND POLICY:

There are no refunds after the first lesson.

There are no refunds or make-up classes for missed lessons.

Only under special circumstances (i.e. injury - with medical note) ONDC will issue a credit to be used at any future date.

PRIVACY:

The Ottawa National Diving Club gathers personal information including, but not limited to, name, address, date of birth, medical conditions and health card number. The information is gathered only for necessary use in the conduct of ONDC business. ONDC respects the privacy of its members and clients and takes those reasonable and necessary steps to safeguard the personal information of its members and athletes. Except as provided below, ONDC will not provide any member or athlete personal information to any third party without the expressed permission of the member and/or athelte. ONDC employees and board members are, for purposes of this section, not third parties.

The member and/or athlete expressly grant permission for the use of the following personal information: ONDC may use names and/or images of athletes for promotional purposes on the ONDC website, newsletters and advertisements; ONDC may post lobby notices that contain athlete names, images and/or meet results and may provide this information to the media for publication or announcement; ONDC will provide athlete personal information to provincial, national, and other sport governing bodies as required, to establish and maintain periodic athlete registration or for a particular even such as a competition or training camp.
